JPTi Submits United Nations Contribution on Enforced Disappearances and Transnational Repression by the United States of America

On 30 January 2026, Justice pour Tous Internationale (JPTi) submitted a formal written contribution to the United Nations Committee on Enforced Disappearances and the Working Group on Enforced or Involuntary Disappearances, in response to their joint Call for Inputs on enforced disappearances in the context of transnational repression.

The contribution, entitled “Enforced Disappearances in the Context of Transnational Repression by the United States of America”, was submitted to both the Committee on Enforced Disappearances and the Working Group on Enforced or Involuntary Disappearances.

The submission provides a legally grounded analysis of how enforced disappearance risks arise in transnational contexts, using the United States of America as a case study of extraterritorial security and enforcement practices. It examines both historical and contemporary patterns, including extraordinary rendition and secret detention, as well as broader architectures of transnational repression linked to prolonged emergency governance, secrecy doctrines, and persistent accountability gaps. The analysis highlights how enforced disappearance, or disappearance-adjacent outcomes, may occur where cross-border deprivation of liberty is combined with concealment of fate or whereabouts and the denial of effective legal protection.


Particular attention is given to the abuse of emergency powers and its impact on United States compliance with international human rights law, notably Articles 2 and 4 of the International Covenant on Civil and Political Rights. The submission underscores the continuing relevance of these concerns beyond past counter-terrorism programmes and addresses all guiding questions of the Call for Inputs, including risk factors, applicable legal frameworks, accountability mechanisms, and measures required to ensure protection, truth, justice, and reparation.
