Justice pour Tous Internationale submitted a report to the UN Human Rights Committee that addresses the United States’ failure to comply with the International Covenant on Civil and Political Rights (ICCPR), in particular Article 4. The report highlights the frequent use of ‘unusual and extraordinary threats’ to justify emergency declarations and sanctions, often without meeting the criteria laid down in Article 4. Since the inception of the National Emergency Act (NEA) and the International Emergency Economic Powers Act (IEEPA), the US has declared 70 national emergencies, over 30 of which remain active, frequently targeting external threats. The report criticises the US stance on the jurisdiction of the ICCPR and its failure to notify the depositary of the Covenant, stating that these practices undermine the protection of human rights. It urges a reassessment of US emergency criteria to align them more closely with international standards.
