Follow-Up Submission to UN Special Rapporteur and Commission of Inquiry on the Occupied Palestinian Territory

On 22 November 2023, Justice pour Tous Internationale (JPTi) submitted a follow-up urgent appeal to the United Nations Special Rapporteur on the situation of human rights in the Occupied Palestinian Territory, Ms. Francesca Albanese, and to the Independent International Commission of Inquiry on the OPT and Israel, reiterating the urgent need for principled action to protect civilian life and uphold international law.

This submission reinforces our earlier correspondence dated 10 November, highlighting the deepening humanitarian catastrophe in Gaza, where over 14,000 individuals—including more than 5,800 children—have been killed, and over 1.6 million have been forcibly displaced. JPTi strongly condemned the ongoing violations of international humanitarian law by the occupying Power and urged an immediate reassessment of the legal paradigms surrounding the right to self-defense, especially in the context of prolonged occupation.
We express our strong support for the courageous work of Ms. Albanese, whose legal and moral clarity offers a compelling framework for redressing the root causes of the Israeli-Palestinian conflict. Our letter calls for a reinterpretation of key legal standards, including the invocation of self-defense under Article 51 of the UN Charter, and urges the international community to treat all parties equally before the law. We further request that the Commission take steps to initiate an advisory opinion before the International Court of Justice concerning the right of Palestinians to self-defense under occupation.
In solidarity with all victims of injustice, JPTi reiterates its call for immediate and decisive international measures, including accountability for war crimes, a ceasefire, and the urgent protection of fundamental rights. We are grateful for the commitment of all UN mandate holders who continue to uphold the principles of international law and human dignity in the face of mass atrocities.
